Legal Agreement: Terms of Service

Banker’s Hours Coworking  provides members (that’s you) with flexible month-to-month membership options. We do not use the terms lease, tenant or landlord because we are not leasing space. All membership options are month to month and can be terminated without notice or reason by Banker’s Hours Coworking.

Banker’s Hours

At Banker’s Hours Coworking, we believe you should work where the money is.  The infamous bank robber Willie Sutton, when asked why he robbed banks, replied with “because that’s where the money is” (or so the legend says).  That epic phrase would go on to represent the obvious and is known as Sutton’s law.  

We think Banker’s Hours is the obvious place for you to work, find inspiration, and above all… community.  As members, we respect each other, our workspace, and our community.  We do ask you to promise to uphold these values along with us. Banker’s Hours staff reserves the right to enter any office unannounced for any reason at any time. 

Be Cool

In consideration of use of the Banker’s Hours facilities, keep it cool by promising to be a part of the community and be inviting:

This could sometimes include: offering to help someone find something. Please treat people like they’re in your home. Show them around or ask how their day was, and if you don’t know them ask what brought them to our space. If someone looks lost point them in the right direction and say, “Good to have you here.” 

If someone is trying to access the door, but can’t get in, that’s ok.  They may not have a membership, so therefore need to speak with a team member.   We’d much rather they wait and call a team member or the person they’re there for than have someone let in and left to wander the space confused.

Opening & Closing

[First one in] Turn on all the lights if they’re not on.  (The light switches are in random locations. We will be sure to show you where they’re at). 

[Before you leave] Make sure your work area is clean.  Use handy-dandy nearby wipes to do a quick clean up to make sure we all stay healthy and safe.  Don’t leave a mess.

Parking

[Options] There are spots to the right of the building as well as in the open parking lot across from the fire department and MadCo brewing company.  On street parking is available too.  Just be aware of any time limitations and please do NOT park in any area with signage dedicating that space to a business or person.

Space Cleanliness

A cleaning crew comes regularly. They DO:

  • Clean and vacuum the common work areas
  • Clean and vacuum the meeting spaces
  • Clean the bathrooms
  • Restock the bathrooms with soap and hand towels
  • Empty waste receptacles
  • Wipe down all surfaces
  • Vacuum office spaces*

*If you have an office share membership, 1x per month light cleaning is included in your benefits.  Please be aware that our cleaning crew will access the office spaces for this purpose.

The cleaning crew DOES NOT:

  • Clean dirty cups, mugs or dishes

As Banker’s Hours  members, we have to take care of some things ourselves. 

    • [Dishes] Please wash, dry and put away your cups, mugs, dishes and silverware. Due to Covid-19, we are currently only providing disposable cups.  If you bring your own dishes, please take them home with you at the end of the day or wash and put them away in the kitchen cabinets.
    • [Guests] We know you’re going to have guests from time to time (and we encourage that) but please make sure to clean-up after them. 
    • [The Trash] If the trash is super full prior to the evening cleaning crew arrival feel free to take it out or let a member of our team know. Ask a member of the Banker’s Hours team where the dumpsters are located.
    • [The Fridge] Don’t leave your takeout from 4 weeks ago in the fridge, please. Label long-term food items like sodas, dressing and creamer. Food that is not labeled and is expired or molding will be thrown out. No exceptions.

 

  • [Vaping or Smoking] Don’t do it. But if you must, please take it outside. No vaping in the meeting spaces, phone rooms, kitchen, or any other communal space inside Banker’s Hours.

 

  • [Coffee] You are welcome to make coffee any time.  We do ask that if you are the only one in the space to use the Kcup option and only brew one cup of coffee as you need it so we cut down on waste.  If there are other members present and it makes sense to brew a pot of coffee, please do so following the instructions by the coffee maker. 

Space Access

The doors at Banker’s Hours are locked 100% of the time unless there is a special event where we allow walk-ins for a predetermined time period. 

Access for members is done using Proximity  App. You must have iOS or Android to download the app.  Once membership is confirmed you will receive an invite and instructions to the appropriate system.

DO NOT prop the door open for any reason. This guideline is in place to ensure the building and members stay as safe and secure as possible.

Meeting Space

Specific membership levels  have access to the meeting rooms. Each membership level is allocated a monthly amount of time to be booked in any of the available rooms.

[Canceling a Booking] Failure to cancel your booking 12 hours in advance of the start time will result in a loss of booking hours.

[Buying More Hours] If you have used your allowed time you can purchase additional meeting space hours at $25/hr for conference room or $15/hr for the office. You are not allowed to use other members' hours for any reason at any time. If you need more hours than what is allocated upon signing up, speak to Banker’s Hours staff to come to a solution.

[Guaranteed availability] We do not guarantee meeting space availability. With that said, we will always do our best to find an accommodation for you if the calendar is looking full. Please reach out to Banker’s Hours staff.

Internet Access

We do everything possible to provide the best internet speeds. Due to forces outside of our control we occasionally have outages. We do not provide refunds or compensate Banker’s Hours members in any way for internet downtime caused by the Internet Service Providers.

Printing

All locations have a printer. Please follow instructions on the printer for use. All members get b&w printing for free. Please see below for your membership specific allowances.

If you have trouble connecting with or using the printer, please let a team member know.  You can connect to the printer via WIFI connection: Brother MFC - L2710DW

Music

Certain open work space areas have music playing  to fuel your productivity mojo. If you notice the music is off or if you want to switch things up, just ask a member of the Banker’s Hours team.

Space Sharing

Everyone is different.  Some people are super social while they work, while others are quiet and focused.  Please respect the work habits and routines our all community members.

If they have their headphones in, please send them a digital message before you bother them in person - it may disrupt their workflow.

For you have headphones on and someone is having a conversation near you (and it’s bothering you), feel free to move somewhere more secluded or politely ask them to keep it down - book the conference room for a little bit, or hop into the phone room. 

People should be able to have short (5-10 minutes)  business conversations wherever as long as the topic is appropriate for other members to hear. 

Personal conversations in person and on the phone should be taken from a meeting space, outside or in one of the phone rooms. 

Be thoughtful and mindful of what you share openly in the space. We’re not library quiet, but we’re not coffee shop loud, either. Some background noise should be expected.

Things that are not appropriate:

  • Speaker phone use in the open workspace. This includes conversation and music playing.
  • Conference calls in the open workspace.

Dedicated Offices (Office Shares)

Members with dedicated offices who want to make any alterations to the space must get approval from Banker’s Hours staff prior to any work being done. This includes but is not limited to, shelving, hanging pictures, plants, etc. 

Upon giving notice of cancelation, you must leave the office as you found it. This includes but is not limited to desk(s) and chair(s) if received upon moving in, any holes or markings fixed. Should you decide to vacate the space, a member of the Banker’s Hours team will review the same steps from move in, upon move out.  If you decide to alter your office in any way without approval, you will see a $500 fee added to your final bill. This covers the cost of repairing any damage to the walls, flooring, as well as repainting the walls for the next member.

 

Private Offices

Members with private offices who want to make any alterations to the space must get approval from Banker’s Hours staff prior to any work being done. This includes but is not limited to, shelving, hanging pictures, plants, etc.

If you receive a special rate that is based on your commitment to a specific time period, i.e. 6 months - you agree to stay a paying member (at the rate determined at sign up) for the specified period of time.  This is not a lease.  If you cancel your membership for a private office before you have met your time comittment, you agree to be charged the difference at time of cancelation.  For example, if you comitt to 6 months at a discounted rate, but cancel at 3 months.  We will charge the difference between your discounted rate and the regular rate for 3 months membership at time of cancelation.  

Guests

You’re welcome to bring guests to join you at Banker’s Hours. The following restrictions apply. 

  • 1 or 2 guests at any given time 2 times a month
  • Guests must be registered at least 24 hours in advance with Banker’s Hours management to utilize the space. Please send taylor@bankershrs.com an email to register your guest
  • You, the member, must be in the space at all times with the guest
  • You, the member, must meet your guest at the door before they arrive. Don’t count on another member to stop the work they’re doing and try to accommodate your guests. 

Dogs

 

At this time, we do not allow pets in the coworking space.  If you’d like to bring your dog with you on work days, please let us know and we’ll take your request into consideration.

 

We love our dogs too, but want to make sure everyone is comfortable in the coworking space. 

Payment

Payment is handled via credit card or ACH  using the coworking software Proximity. Payment occurs on membership start date and then recurs automatically on the first of the month until membership is cancelled.  You can cancel your membership at any time. You explicitly agree that we have your authorization to charge your credit card on a recurring basis.

If you start on another day then the 1st of a month the charge will be prorated.

[Failure to Pay] Failure to pay overdue invoices after 7 days of the 1st of the month will result in loss of access to the space. If something’s going on and you need consideration, let us know.

Termination

Banker’s Hours Coworking reserves the right to terminate any membership at any time without notice and without a refund.

Failure to follow any of the guidelines outlined in this document can result in termination of membership.

Liability

Indemnification and Release of Liability. In consideration for receiving permission to use the Banker’s Hours Coworking, you RELEASE, WAIVE, AND DISCHARGE, and agree to INDEMNIFY AND HOLD HARMLESS the Banker’s Hours Coworking, its officers, agents, or employees (hereinafter referred to as RELEASEES) from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by you or your guests, or to any property belonging to you or your guests, while in or on the premises, IF SUCH LOSS IS CAUSED BY YOUR ACTION, INACTION, OR NEGLIGENCE and regardless of whether such liability arises in tort, contract, strict liability, or otherwise, to the fullest extent allowed by law.

You voluntarily assume full responsibility for any risks of loss, property damage, or personal injury, including death that may be sustained by you or your guests, or any loss or damage to property owned by you or them IF CAUSED BY YOUR OWN OR YOUR GUESTS’ ACTIONS, INACTIONS, OR NEGLIGENCE , to the fullest extent allowed by law. 

Governing Law. (Let's keep it local) This Agreement shall be governed by and construed in accordance with the laws of the State of North Carolina. The parties consent to the exclusive jurisdiction and venue in the federal and state courts sitting in Madison County, North Carolina.

Office Move In / Move Out

 

On the day of your office move-in, the Banker’s Hours team member will review the space and provide furniture (desk & chair) for you.  Upon your exit, a move out review will be scheduled 2 weeks prior to your final day to discuss any alterations you have made to the space, and the expectation to return the space and furniture as it was provided to you.

Cancellation

 

For The Any Time Membership or The Every Now & Then Membership - you can cancel your membership at any time, however, there is no refund for partial months.  Your membership is paid on the 1st of every month, so if you cancel on the 2nd or the 20th, your membership is valid through the end of the month paid.

For shared office space, a full, 1-month notice is required for cancellation. This means if it’s Jan. 2 and you send in your notice, your last month in the space is in February. Notice of cancellation must be in written form via an email to Michelle@bankershrs.com. 

Acts of God

In the words of someone who is probably smarter than us, shit happens. That includes things like spontaneous Internet outages, hurricanes, tornadoes, pandemics, wars, trees falling, spontaneous combustion, and probably a few more things we’re not thinking of, that are completely out of our control - and yours, too. 

We’ll broadly label these kinds of things “acts of God.” If something happens and Banker’s Hours needs to close for an act of God for any reason, you are still required to follow each section of the membership agreement you’re agreeing to here, including the cancellation policy above and the refund policy below. If something crazy is going on, know we’ll work with you, but we need you to work with us, too.
